The decision explicitly overrules the Fourth Circuit’s decision in Jordon v. Alternative Resources Corp., 458 F.3d 332 (4th Cir. 2006), which held the converse. Wormuth, No. 21-1766 (4th Cir. 2022), the Fourth Circuit confirmed that Title VII’s prohibition against retaliation for complaints about discrimination includes creating a hostile work environment as a category of prohibited retaliation., In doing so, the Fourth Circuit has clarified the standards for what constitutes actionable harassment in the workplace., As the Sowash and Webster cases make clear, Title VII does condemn all rude or boorish behavior at work, and that there is nothing inherently unlawful under Title VII about being a “general purpose jackass” in the workplace., The Fourth Circuit also found support in the Supreme Court’s decision in Bostock v.
